FACE OF ROVER CONTEST: Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
Sponsor: Face of Rover Photo Ad Contest (“Contest”) is sponsored by A Place for Rover, Inc., 2101 4th Ave., Suite 400, Seattle, WA 98121 (“Sponsor”). This Contest is in no way sponsored, endorsed or administered by Facebook. By entering this Contest, you are providing information to Sponsor and not to Facebook.
Eligibility: This Contest is open only to individuals who are legal residents of Seattle, WA and are at least 18 years of age (or over the age of majority in their state of permanent legal residence, whichever is older) at the time of entry. Directors, officers, and employees of Sponsor and any of each of their respective parent companies, affiliates, subsidiaries, agents, professional advisors, and advertising and promotional agencies, and their immediate families and household members, are not eligible to enter the Contest or win any prizes.
Entry Period: The entry period for this Contest begins on Wednesday, July 20, 2016 at 8:00 am and ends on Wednesday, August 3, 2016 at 5:00 pm (all times in these Official Rules are Pacific Time) (the “Entry Period”). All entries must be received by Sponsor during the Entry Period.
How to Enter: Limit one entry per person and per Facebook account. To enter, you must first be logged in as a registered user of Facebook. (If you are not a registered Facebook user, you can register for free at www.facebook.com.) While you are logged in to your Facebook user account, do the following, during the Entry Period: (1) visit Rover’s Facebook page at www.facebook.com/RoverDotCom; (2) click the Contest entry post at the top of the page; and (3) upload one photo of your dog at their cutest, sweetest, or silliest. (the “Entry”) via the Comment section to the Contest post. Entries must: (a) be submitted in digital form via the Facebook page as listed above; (b) be suitable for general audiences and not offensive, obscene, defamatory or illegal; (c) be original (and you must own or control the copyright to your Entry and have sufficient rights to submit the work to this Contest and to grant permission to Sponsor to use the Entry, as described below); and (d) not violate the rights of others or any policies or terms of Facebook. By entering this Contest, you certify that you have complied with and accept these Official Rules and are eligible to win, and you give your express permission to be contacted by the Sponsor (and third-parties directed by Sponsor) through your Facebook account and at any email address or telephone number you provide in connection with this Contest. You also agree that all decisions of Sponsor in administering the Contest are within Sponsor’s sole discretion and are final.
Winner Selection: All entrants/entries are subject to verification at Sponsor’s sole discretion. After the Entry period, a panel of judges comprised of representatives from Sponsor will review all eligible Entries received by Sponsor that have not been removed from Facebook or otherwise disqualified. On or about Thursday, August 4, 2016, the panel will select a winning Entry that the panel determines, in the judges’ sole discretion, to be the most apt, interesting and appealing based on the following judging criteria:
- Creativity: how well the Entry demonstrates your originality and creativity
- Emotion: the degree to which the Entry shows a humorous, loving or other unique relationship with your dog
- Visual appeal: the overall artistic and photographic quality and of the Entry
In the unlikely event of a tie, the panel will re-review the Entries involved and choose an applicable winner based on the above criteria. The winning entrant will be notified by email to the Facebook account used to submit the Entry (the “Winner Notification”). Potential winners may be required, within three (3) days of Winner Notification being sent, to: (1) provide to Sponsor further contact and residence information; and to(2) execute and deliver a written affidavit of eligibility, acceptance of these Official Rules, release of liability/publicity, tax forms, and other reasonable documentation; and (3) agree and be able to travel to (at their sole expense), and appear for a 3-hour live photo shoot with their dog, at the Rover.com office (2101 4th Ave #400, Seattle, WA 98121) on a mutually-agreeable day and time during the week of August 8-12, 2016. (In the event that a potential winner does not timely satisfy all of the above requirements or a mutually-agreeable time for the photo shoot cannot, in Sponsor’s discretion, be readily established, disqualification may result and an alternate winner may be selected based on the criteria listed above.)
Odds of Winning: Odds of winning depend on the quality and number of eligible Entries received. Many will enter; few will win.
Prize: One (1) prize will be awarded, consisting of: A photo of your dog featured on Rover.com bus ads running in Seattle, WA. a professional-quality photo shoot of the winner’s dog (the “Winning Photo Shoot”), from which the winner may select up to five (5) digital images for personal use (the “Prize”). Approximate retail value of Prize: US $1,000. Any difference between the approximate retail value and the actual value of the Prize will not be awarded. Prizes returned as undeliverable or otherwise not claimed or accepted by the applicable entrant within seven days after delivery may, at Sponsor’s discretion, be forfeited and awarded to an alternate winner. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. All prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). All federal, state and local taxes associated with the receipt or use of any Prize are the sole responsibility of the winner.
Sponsor’s License to Use Winning Photo Shoot Photos: By entering the Contest and appearing for the Winner’s Photo Shoot, the winner grants to Sponsor (and any division or affiliate of Sponsor), without additional compensation: (a) the right to use and publish the winner’s (and his or her dog’s) name, likeness and other submission information, and (b) a non-exclusive, worldwide, perpetual, royalty-free, fully paid-up license to display, publish, reproduce, communicate to the public, perform, distribute, adapt, edit, modify, translate, create derivative works based on, and otherwise use and sublicense, any photos or other results and proceeds of the Winning Photo Shoot, or any portion thereof, in advertisements appearing on busses in the Seattle, Washington area, and/or in Sponsor’s other trade, advertising or other promotional materials in any media (including on Sponsor’s website and Facebook page), without further compensation or notification to, or permission from, the winner or any third party. For these purposes, the winner agrees that it is his or her sole responsibility to obtain all permissions and releases necessary for the grant of the rights contained in this paragraph (including from any owner of winner’s dog, if winner is not the sole owner). The winner also agrees to take, at Sponsor’s expense (but without compensation), any further action (including, without limitation, execution of affidavits, licenses, and other documents) reasonably requested by Sponsor to effect, perfect, or confirm Sponsor’s rights set forth in these Official Rules. Sponsor will have no obligation to publish, use or retain any photos from the Winning Photo Shoot, any such use being in Sponsor’s sole discretion.
Sponsor’s License to Use Entry: By entering the Contest, you grant to Sponsor (and any division or affiliate of Sponsor), without additional compensation: (a) the right to use and publish your name, likeness and other submission information, and (b) a non-exclusive, worldwide, perpetual, royalty-free, fully paid-up license to display, publish, reproduce, communicate to the public, perform, distribute, adapt, edit, modify, translate, create derivative works based on, and otherwise use and sublicense, your Entry, or any portion thereof, via Facebook, Sponsor’s website, and in Sponsor’s trade, advertising or other promotional materials in any media, without further compensation or notification to, or permission from, you or any third party. For these purposes, you (or the photographer/creator of the Entry, if not you) waive all “moral rights” under any applicable law to either object to modification of your Entry or require artistic credit in conjunction with your Entry. To the extent such waivers are not permitted by applicable law, you (or the photographer/creator) agree not to enforce such moral rights against Sponsor. You agree that it is your sole responsibility to obtain all permissions and releases necessary for the grant of the rights contained in this paragraph. You also agree to take, at Sponsor’s expense (but without compensation to you), any further action (including, without limitation, execution of affidavits, licenses, and other documents) reasonably requested by Sponsor to effect, perfect, or confirm Sponsor’s rights set forth in these Official Rules. Sponsor will have no obligation to publish, use or retain any Entry you submit or to return any such Entry to you.
Non-Infringing Entry Materials: You represent and warrant that (a) you have the right to grant the rights granted in these Official Rules or, alternatively, you have obtained all necessary rights and permissions to use and submit your Entry in connection with the Contest and to provide all the rights specified in these Official Rules; and (b) your Entry and the use of your Entry (and, if you are the winner, any photos from the Winning Shoot) as contemplated in these Official Rules does not and will not violate, misappropriate, or infringe upon any law or regulation or the rights of any third party, including without limitation any copyright, trademark, or any rights of publicity or privacy, or any other intellectual property or other rights.
Identity of Entrant: If a dispute arises about the identity of the entrant, the authorized account holder of the Facebook account through which the Entry was submitted at the time of Entry will be considered the entrant. An authorized account holder is defined as the natural person who is assigned to a Facebook account by Facebook. Potential winners may be required to provide Sponsor with proof that the potential winner is the authorized holder of the Facebook account associated with a winning Entry.
Personal Information: Information collected from each entrant is subject to Sponsor’s Privacy Policy, which may be found at https://www.rover.com/privacy/ (or successor URL).
Release of Liability: Sponsor will not be responsible for late, lost, illegible, incomplete, damaged, or misdirected entries or for any technical or human error in administration of this Contest and accepts no responsibility for any injury, loss, or damage of any kind resulting from an entrant’s participation in this Contest. By entering this Contest, you release Sponsor, Facebook, and each of their affiliates and representatives from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with this Contest or delivery, misdelivery, acceptance, possession, use of or inability to use a prize (including, without limitation, claims, costs, injuries, losses, and damages related to personal injuries, death, and damage to or destruction of property, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), or warranty, or any other theory.
Additional Terms and Conditions: This Contest and these Official Rules will be governed, construed, interpreted, and enforced under the laws of the State of Washington. This Contest is subject to all applicable federal, state, and municipal laws, and is void where prohibited. Sponsor reserves the right to amend these Official Rules or to terminate this Contest. Any provision of these Official Rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these Official Rules will remain in effect.
